These Terms of Use (“Terms”) govern your access to and use of the website at hyvia.io (the “Site”), operated by [HYVIA LEGAL ENTITY NAME], a company registered in Austria (“Hyvia”, “we”, “us”). By using the Site you agree to these Terms. If you do not agree, please do not use the Site.

1. The Site vs. the Hyvia platform

These Terms cover the public Site only. Access to and use of the Hyvia platform (the mobile app, wearable devices, and coach dashboard) is governed by a separate written agreement between Hyvia and the club or organisation, not by these Terms.

2. Fitness-grade, not a medical device

Hyvia provides fitness-grade performance and readiness monitoring. Hyvia is not a medical device and is not intended to diagnose, treat, cure, prevent, or monitor any disease or medical condition. Nothing on the Site is medical advice. The information, scores, and insights Hyvia produces are intended to support the decisions of qualified coaching, performance, and medical staff — they do not replace professional medical judgement. Always seek the advice of a qualified professional for any health question, and never disregard or delay it because of something provided by Hyvia.

3. Acceptable use

You agree not to misuse the Site. In particular, you will not:

  • use the Site in breach of any applicable law;
  • attempt to gain unauthorised access to, disrupt, or interfere with the Site or its systems;
  • copy, scrape, or harvest content or data except as permitted by these Terms; or
  • use the Site to transmit malware or engage in any fraudulent or harmful activity.

4. Intellectual property

The Site and its content — including text, graphics, logos, the Hyvia name and brand, and software — are owned by Hyvia or its licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable licence to view the Site for its intended purpose. No other rights are granted.

5. Demo requests

Submitting a demo request does not create any contract or obligation on either side. We will use your details to respond to your enquiry, as described in our Privacy Policy.

6. Third-party links

The Site may link to third-party websites or services that we do not control. We are not responsible for their content, and linking does not imply endorsement.

7. Disclaimers

The Site is provided “as is” and “as available”, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that the information on it is complete or up to date.

8. Limitation of liability

To the fullest extent permitted by applicable law, Hyvia will not be liable for any indirect, incidental, or consequential loss arising from your use of the Site. Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law (including for death or personal injury caused by negligence, or for fraud).

We may update these Terms from time to time. Changes take effect when posted on this page; the “last updated” date above reflects the latest version. Your continued use of the Site means you accept the updated Terms.

10. Governing law and contact
